Jceraw Terms of Use

Welcome to jceraw.com (the “Site”), operated by Jceraw (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site, including all features, content, and services available through the platform—such as browsing products, creating user accounts, submitting reviews, and engaging with our brand. By accessing or using the Site, you (“you” or “User”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree to these Terms, please do not use the Site.

Eligibility to Use the Site

To use the Site and its services, you must meet the following eligibility requirements:
  • You must be at least 18 years of age, or if you are under 18, you must use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • You must have the legal capacity to enter into a binding contract (e.g., not be a minor in your jurisdiction without parental/guardian consent, not be adjudicated incompetent).
  • You must not be prohibited from using the Site by any applicable law, or by a prior agreement with jceraw (e.g., due to a previous violation of these Terms).
  • If you are using the Site on behalf of a business, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.

User Accounts

Creating a user account on the Site allows you to access additional features, such as saving favorite products, tracking orders, and managing shipping addresses. Your account is subject to the following terms:

Account Creation & Maintenance

  • When creating an account, you must provide accurate, current, and complete information (e.g., valid email address, full name). You agree to update this information promptly if it changes (e.g., new email address, updated phone number).
  • You are solely responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities that occur under your account. Do not share your credentials with third parties.
  • If you suspect unauthorized access to your account, you must notify us immediately at service@jceraw.com to minimize potential harm. We are not liable for any losses or damages resulting from your failure to secure your account.

Account Termination

We reserve the right to suspend or terminate your account, with or without notice, if we determine that you have violated these Terms (e.g., fraudulent activity, misuse of the Site). You may also terminate your account at any time by contacting our support team. Upon termination, your access to account-specific features (e.g., saved favorites, order history) will be revoked, but we may retain certain data as required by law or for legitimate business purposes (e.g., order records).

You may use the Site only for lawful, personal, and non-commercial purposes that align with its intended functionality. Permitted uses include:

  • Creating and managing a user account to track orders, save favorite items, and streamline the checkout process.
  • Submitting honest, accurate product reviews and ratings (in compliance with our Review Guidelines, outlined below).
  • Contacting our customer support team with questions, concerns, or requests related to the Site or our products.
  • Using the Site’s self-service tools (e.g., sizing charts, shipping calculators) to make informed purchasing decisions.

Prohibited Uses of the Site

To protect the Site, our users, and our business, you are strictly prohibited from engaging in the following activities:
  • Illegal or Harmful Activities: Using the Site to violate any local, state, federal, or international law; to promote or facilitate illegal activities (e.g., fraud, counterfeiting); or to harm, threaten, or harass other users or our team.
  • Unauthorized Access: Attempting to gain unauthorized access to the Site’s backend systems, user accounts, or stored data; using automated tools (e.g., bots, scrapers) to access, collect, or extract content from the Site without our prior written permission.
  • Misuse of Content: Copying, reproducing, distributing, modifying, or publicly displaying the Site’s content (text, images, logos, product designs) without our explicit written consent (see “Intellectual Property” section below).
  • Fraudulent Conduct: Providing false or misleading information (e.g., fake email addresses, stolen payment details) when creating an account or placing an order; impersonating another person, business, or entity (e.g., pretending to be jceraw staff).
  • Disrupting the Site: Uploading or transmitting viruses, malware, or other harmful code; engaging in activities that could disable, overburden, or damage the Site’s infrastructure (e.g., DDoS attacks); interfering with other users’ access to the Site.
  • Abusing Promotions: Creating multiple accounts to exploit limited-time offers, coupon codes, or discounts; sharing coupon codes publicly if they are marked as “personal” or “non-transferable.”
  • Posting Inappropriate Content: Submitting product reviews, comments, or messages that contain profanity, hate speech, discrimination (based on race, gender, religion, etc.), explicit content, or misleading information.

Intellectual Property Rights

All content and materials on the Site—including but not limited to logos, trademarks, product images, photographs, text, graphics, and software (collectively, “Intellectual Property”)—are owned by jceraw or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
  • You do not acquire any ownership rights to the Site’s Intellectual Property by accessing or using the Site. A limited, non-exclusive, non-transferable license to use the Site for permitted purposes is granted to you, but this license may be revoked at any time if you violate these Terms.
  • You may not use our trademarks (e.g., “jceraw”) or logos in any way (e.g., in advertising, on other websites) without our prior written permission. Unauthorized use may violate trademark laws and result in legal action.
  • If you believe that your intellectual property rights have been infringed on the Site (e.g., a product image that violates your copyright), contact us at service@jceraw.com with detailed information about the infringement, and we will investigate promptly.

User-Generated Content (UGC)

User-generated content includes product reviews, ratings, comments, and any other content you submit to the Site. By posting UGC, you agree to the following terms:

Review Guidelines

  • All reviews must be honest, accurate, and based on your personal experience with the product. Do not post reviews for products you have not purchased or used.
  • Reviews must not contain profanity, hate speech, personal attacks, confidential information (yours or others’), or promotional content for other businesses.
  • We reserve the right to moderate, edit, or remove any UGC that violates these guidelines or our Terms, without prior notice. We may also reject reviews that are irrelevant, repetitive, or appear to be fraudulent (e.g., multiple identical reviews from the same user).

License to UGC

By submitting UGC to the Site, you grant jceraw a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, distribute, display, and modify that content for business purposes—such as featuring reviews on product pages, promoting the Site on social media, or improving our services. This license does not affect your ownership of the content, but it allows us to use it to enhance the Site for all users.

Site Availability & Modifications

We strive to keep the Site available 24/7, but we cannot guarantee uninterrupted access. We may need to temporarily suspend the Site for maintenance, updates, or technical issues, and we will notify users of planned outages when possible.
We reserve the right to modify or discontinue any feature, content, or service on the Site at any time, with or without notice. This includes adding new product categories, updating the Site’s design, or removing outdated content. We will not be liable to you for any losses resulting from these modifications or discontinuations.

Links to Third-Party Websites

The Site may contain links to third-party websites or services (e.g., payment processors like PayPal, social media platforms like Instagram). These links are provided for your convenience only, and we do not control or endorse the content, privacy policies, or practices of these third parties.
We are not liable for any damages or losses resulting from your use of third-party websites. You should review the terms of use and privacy policies of any third-party site before accessing or using it.

Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JCERAW DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
  • Implied warranties of merchantability (e.g., that the Site will function as expected) and fitness for a particular purpose (e.g., that the Site will meet your specific needs).
  • Warranties that the Site will be error-free, secure, or uninterrupted.
  • Warranties regarding the accuracy, completeness, or reliability of the Site’s content (e.g., product descriptions, pricing).
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, any implied warranties will be limited to the maximum extent permitted by law.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JCERAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SITE. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
Our total liability to you for any claim related to these Terms or the Site shall not exceed $100 USD. This limitation applies regardless of the cause of action (e.g., breach of contract, negligence) and does not apply to damages caused by our gross negligence, willful misconduct, or failure to comply with applicable consumer protection laws.

Changes to These Terms

We may update these Terms periodically to reflect changes in our business practices, technology, or applicable laws. When we make material changes (e.g., modifying prohibited uses, updating our intellectual property policies), we will:
  • Post the revised Terms on the Site with a clear notice indicating the update date.
  • Send an email notification to users who have opted in to communications, if the changes significantly impact their rights or obligations.
Your continued use of the Site after the revised Terms take effect constitutes your acceptance of the updated terms. We encourage you to review these Terms periodically to stay informed about your rights and responsibilities.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of laws principles.
Any disputes arising out of or related to these Terms or your use of the Site shall first be resolved through good-faith negotiation between you and jceraw. If negotiation fails, the dispute shall be brought exclusively in the courts located in Russell County, Alabama, and you consent to the personal jurisdiction of those courts.
